Bio Sketch

Charles Kaiser’s practice encompasses oil and gas, coal, general mining, and Indian matters, where he serves as both a counselor and litigator.  He has particular expertise in issues involving federal, state, and Indian lands and working with agencies that manage activities on those lands, such as the Bureau of Land Management, the U.S. Forest Service, the Office of Surface Mining, the Bureau of Indian Affairs, and their state and tribal counterparts.  He frequently represents clients in matters of national significance, such as litigation establishing the ownership of coalbed gas (see, e.g., Amoco Production Company v. Southern Ute Indian Tribe, 526 U.S. 865 (1999), aff’g, 874 F.Supp. 1142 (D. Colo. 1995)), representing the owners of the Trans-Alaska Pipeline in the successful renewal of rights-of-way and other authorizations for the 800-mile pipeline that crosses federal, state, and native lands between Prudhoe Bay and Valdez, and defending recent federal government decisions providing for the drilling of tens of thousands of oil and gas wells in the Powder River Basin in Wyoming and Montana and the San Juan Basin in New Mexico and Colorado (see, e.g., San Juan Citizens Alliance et al. v. Norton et al., CV-04-1038 (D.N.M.); Western Organization of Resource Councils et al. v. Clarke et al., No. 04-CV-0018 (D. Wyo.)).  He has often counseled clients and litigated matters involving the Ute Indian Tribe of the Uintah and Ouray Reservation, the Southern Ute Indian Tribe, the Navajo Nation, the Jicarilla Indian Tribe, the Ute Mountain Ute Indian Tribe, the Arapahoe and Shoshone Indian Tribes, the Blackfeet Indian Tribe, and other Native American groups.  He was recently retained by the Governor and Attorney General of Wyoming to assist the State in development of certain of its natural resources.
