Case Study: Migrating Release

We represented Ventex, LLC in a property damage and personal injury lawsuit filed by a neighboring business and its employee when a release from an underground storage tank allegedly migrated onto the neighboring property, contaminated soil and groundwater, and the employee was allegedly exposed to high levels of gasoline vapors.  We worked with regulators to develop an appropriate Corrective Action Plan for the site, rather than the plan demanded by adjacent property owners.  We settled both the property damage and personal injury actions on favorable terms for the client.  We also represented Ventex in its protest before the Petroleum Storage Tank Committee and obtained a favorable settlement of the protest.
