Case Study: Reporting Improper Waste Disposal

We represented an equipment company in a case in which it had inadvertently disposed of hazardous waste under a non-hazardous waste manifest provided by its client, the generator of the waste, resulting in disputes with the landfill, generator, and insurance company.  We assisted the client in self-reporting the improper disposal and in obtaining insurance coverage for the event.  The State did not take any enforcement action against our client, and insurance coverage was obtained.
