Case Study: Patent Infringement
We brought a patent infringement suit on behalf of a patent holder. The defendant counterclaimed for antitrust tying and misuse of patent, and defended on grounds of invalidity and non-infringement, on-sale bar, inequitable conduct and other defenses. After a three-week trial, the trial court ruled the patent was invalid. The Federal Circuit reversed and the trial court then found no infringement, which ruling was also reversed by the Federal Circuit. The trial court then awarded inadequate damages, and after a third reversal, the defendants agreed to an eight-figure settlement.
