Case Study:  Right-of-Way

DGS represented a consortium of the world’s largest oil and gas companies in successfully renewing the federal right-of-way for the Trans-Alaska Pipeline System (“TAPs”).  We advised the companies on all aspects of the TAPs right-of-way renewal, from the SF-299 application process through the Secretary of the Department of the Interior’s signing of the record of decision approving the renewal.  We routinely work with clients in obtaining, defending, and renewing rights-of-way on federal lands under Title V of the Federal Land Policy Management Act and Section 28 of the Mineral Leasing Act and on Tribal and Allotted Indian lands under the unique Indian right-of-way statutory and regulatory regime.  As an example of the latter, we recently assisted a large oil and gas company in negotiating the renewal of extensive rights-of-way with an Indian Tribe within the San Juan Basin.
