Case Study: Office Park Campus Development
The Real Estate Group has represented a major Denver area high-tech company in the development of an office park campus in Broomfield, Colorado. The work included revising the purchase and sale agreement to accommodate an off-balance sheet financing structure for the acquisition of the property, the negotiation and preparation of agreements for the entitlements for the project with the city of Broomfield, including provisions for tax incentives and other municipal subsidies and allocation of responsibilities for infrastructure to serve the project among the client, the seller, and the city of Broomfield, prepared and negotiated the design-build, cost-plus, guaranteed maximum price construction contract for the construction of the first building in the campus, and assisted in the negotiation of the synthetic lease to provide acquisition, development, and construction financing for the project, and handling the simultaneous closing of that financing with the acquisition of the property for the project.
