Case Study: Electrical Capacity Developer Acquisitions
The Real Estate Group represents companies creating new electrical capacity for the Colorado Front Range using gas-fired turbines, combined cycle systems and renewable wind energy to provide power under agreements with Public Service Company of Colorado. Over the past year, we have represented the developer of a 300 MW gas-fired single cycle gas turbine electric peaking power generation plant in Weld County, through a process which required the Real Estate Group to take the lead on acquisition of the property, annexation, subdivision, zoning, PUD and site plan approvals, inclusion in and exclusion from special districts and to assist with negotiations between the client and Public Service Company of Colorado in connection with a subordinated mortgage and sale of a substation site, and the financing of the project. The project is under construction and slated for start-up in Spring, 2007. We also represented the developer of a wind project of 40 turbines producing 50 to 60 MW of electricity located on more than 40,000 acres in northeastern Colorado. The Real Estate Group is presently in the process of assisting with the expansion of that wind project, working with the client on land use and financing issues.
