Case Study: Summary Judgment in Northern Idaho Toxic Tort Class Action

In a Northern Idaho toxic tort class action, DGS attorneys obtained a summary judgment victory. The plaintiff class sought over $100 million in property damages from our client and several mining companies for alleged metals contamination from mine waste materials on their properties.   It also sought damages for medical monitoring claims.   The state court found that the class claims were barred by a statute of limitations.
