Erin Eiselein’s practice consists of litigation and counseling with an emphasis on health care law, antitrust and trade matters, and electronic discovery. She has a wide variety of complex commercial litigation experience, representing clients in cases involving misappropriation of trade secrets, trademark infringement, insurance recovery, employment discrimination, First Amendment rights, contract law, and appellate matters. Ms. Eiselein’s practice extends internationally as well; she has represented foreign corporations in commercial matters pending in the United States.
A significant portion of Ms. Eiselein’s practice is devoted to counseling clients in the health care industry. Ms. Eiselein has particular expertise in patient privacy matters, including state patient confidentiality laws and HIPAA. She routinely assists clients on contractual matters, ensuring that they do not run afoul of state and federal fraud and abuse laws and the myriad of other laws and regulations governing the health care industry. Ms. Eiselein is a regular contributor to the DGS Health Law Blog and was recognized by Colorado Super Lawyers as a 2010 Rising Star in the field of health care law.
Ms. Eiselein also is experienced in the field of electronic discovery. She is the co-chair of the firm’s Electronically-Stored-Information-Team and a former member of the Sedona Conference Working Group 1 on Electronic Document Retention & Production. Ms. Eiselein has counseled clients on implementing effective document retention and litigation hold policies, strategies for preserving, organizing, and producing electronic data, and minimizing the risk of sanctions for the spoliation of electronic evidence.
Pro bono work is an important part of Ms. Eiselein’s practice. She has volunteered with the Rocky Mountain Children’s Law Center, is a member of the Education Task Force of the Colorado Lawyers’ Committee, and has worked as a cooperating pro bono attorney with the American Civil Liberties Union.
Ms. Eiselein spent five years serving on the Board of Directors of Socially Conscious Coffee, a non-profit organization dedicated to providing education, health care, and opportunity to coffee harvesters and their families in Brazil. Her peers in the Denver legal community recognized her commitment to pro bono work when they nominated her for the Denver Business Journal’s 2004 Pro Bono Attorney of the Year.
She is a member of the American, Colorado, and Denver Bar Associations, and the American Health Lawyers Association.
