Profile

Tom Bell is an AV-rated Trial Partner and a Registered Professional Civil Engineer.  He represents clients in multi-million dollar lawsuits involving breach of contract, breach of warranty, fraud, breach of fiduciary duties, interference with business relations and other contract and tort claims.  Mr. Bell also has in-depth experience in construction and real estate mediation, arbitration, litigation and appeals and in representing creditors in bankruptcy and workouts.  He focuses on resolving disputes through mediation and arbitration to avoid the time and expense of litigation, but if necessary, he brings an extensive background in litigation and appeals in state and federal courts.

Mr. Bell is a contributing author of The Practitioner’s Guide to Colorado Construction Law (2003, 2005, 2007 and 2010 Supplements).  He has lectured on the resolution of construction disputes, construction claims management and construction projects.  Mr. Bell has also been named as a 2007 Colorado Super Lawyer by Law & Politics magazine.

Prior to joining Davis Graham & Stubbs, Mr. Bell served as a clerk for the Honorable Alfred A. Arraj, United States District Court for the District of Colorado.

Examples of Mr. Bell’s practice include:

  • Representing a prominent Colorado family’s trust in a two-week trial against claims exceeding $42 million for breach of fiduciary duties arising in a transaction in which the family trust purchased $100 million of convertible securities from a public company controlled by the family trust.
  • Representing a group of investors to recover a Colorado golf course development from the president of the company in which clients invested who illegally transferred the property to a company owned by the president’s family.  He assisted in negotiating the sale of the golf course on behalf of the client for $5.8 million.
  • Defending a Bank/Trustee against breach of fiduciary duty claims in a two-week trial.  Plaintiffs, beneficiaries, alleged that the trustee breached its duties by making an unauthorized loan in which the bank acted as trustee and lender relating to a multi-million dollar financing of Denver’s Colorado National Bank building.
  • Representing an international engineering consulting company headquartered in Denver that purchased a Pennsylvania-based geotechnical construction company in a four-week jury trial seeking recovery of more than $20 million on claims including breaches of representation and warranties contained in the asset purchase agreement fraud and negligent misrepresentation.
  • Representing an international franchisor in a three-week arbitration against claims exceeding $40 million asserted by the claimant who alleged that its exclusive contract to sell franchises was wrongfully terminated.
