Bio Sketch

Erin Eiselein’s practice consists of litigation and counseling with an emphasis on health care law and antitrust and trade matters. She routinely counsels clients on patient privacy matters, including state patient confidentiality laws and the HIPAA Privacy Rule. She has a wide variety of complex commercial litigation experience, representing clients in cases involving misappropriation of trade secrets, trademark infringement, insurance recovery, employment discrimination, First Amendment rights, contract law, and appellate matters. Ms. Eiselein’s practice extends internationally as well; she has represented foreign corporations in commercial matters pending in the United States.

Ms. Eiselein also is experienced in the emerging field of electronic discovery. She is the co-chair of the firm’s ESI-Team and a member of the Sedona Conference Working Group 1 on Electronic Document Rentention & Production. Ms. Eiselein has counseled clients on implementing effective document retention and litigation hold policies, strategies for preserving, organizing, and producing electronic data, and minimizing the risk of sanctions for the spoliation of electronic evidence. In addition to counseling, she has represented clients with e-discovery issues in internal investigations and litigation. Ms. Eiselein has written articles and given presentations on a variety of e-discovery issues, and was a speaker at IQPC’s 2nd E-Discovery Conference in New York.
