Case Study:  Hostile Work Environment

We represented a hospital in a Title VII suit by employees who claimed they were mistreated due to their race and national origin.  DGS attorneys Andy Low and Janet Savage persuaded the Tenth Circuit Court of Appeals that the plaintiffs in a Title VII case bear the burden of proving that their claims are timely.  The plaintiffs' failure to submit documents showing they had filed timely charges of discrimination led the court to affirm summary judgment in favor of the hospital.
