Media & First Amendment

For more than 30 years Davis Graham & Stubbs LLP has represented a network affiliated television station, and at one time or another has represented all of the major television networks and several other television stations. This work has included pre-broadcast defamation counseling, resistance to subpoenas issued to stations or reporters, advice on employee disputes, litigation, and obtaining expanded media coverage (televised coverage) of numerous criminal and civil trials and appeals. Our lawyers drafted and were instrumental in obtaining the enactment of Colorado’s Reporter Shield statute, which is one of the most protective in the United States. We also wrote and obtained approval of Colorado’s expanded media coverage rule by the Colorado Supreme Court.

DGS also represents every major outdoor advertising company in Colorado. This representation has regularly implicated issues of First Amendment regulation by local governmental agencies. We have litigated and lobbied for the protection of commercial speech since even before the United States Supreme Court extended protection under the First Amendment to such speech.
