White Collar Defense & Investigations

Criminal prosecuting agencies are focusing now, more than ever, on conduct that traditionally has warranted only civil exposure and penalties. This is especially true for corporate cases involving significant investor economic loss, personal injury or death, or harm to the environment โ€“ cases in which federal and state enforcement agencies are likely to be involved. Davis Graham & Stubbs LLP is at the forefront of fending off enforcement actions, indictments, and criminal charges in complex commercial matters and in defending criminal cases when filed.

In the past several years, DGS has been involved in the defense of some of the most high-profile white collar cases in the Western U.S. Each of our white collar lawyers has extensive criminal litigation experience and experience in defending corporations, individuals, and "pools" of witnesses in federal and state white collar investigations. We have successfully provided criminal defenses, and corresponding civil defenses, in cases involving allegations of:

While our work on behalf of clients includes grand jury representation and post-indictment criminal defense, we also work to head-off charges with vigorous pre-indictment defense, targeted to achieve "no-file" decisions by prosecuting authorities. We have credibility, an established presence, and rapport with prosecuting and enforcement agencies across the U.S. While seen as trustworthy and reliable, DGS is also known by enforcers as a formidable litigation group and trial threat. Most of the attorneys in the DGS White Collar Defense & Investigations Group have substantial government experience, having been prosecutors or public defenders. As a result, they have substantial criminal trial experience.

Our white collar attorneys handle a variety of internal investigations and mandatory disclosures. Our experience with and knowledge of directorsโ€™ obligations and responsibilities has allowed us to assist boards of directors and directorsโ€™ committees in conducting internal investigations that are thorough and cost effective.

To best serve its clients, DGS conducts its work with a low profile. Many of our best successes happen outside the courtroom, resulting from quiet negotiations to achieve excellent results. However, we also have extensive experience in defending media-charged matters and in defusing negative media in high profile cases.
